Acceptance of Terms
Agreement
By accessing or using the 100xSales platform, website, or any associated services, you agree to be bound by these Terms and Conditions, our Privacy Policy, and all applicable laws and regulations. If you do not agree to these terms, you may not use our services.
Eligibility
You must be at least 18 years of age and have the legal authority to enter into binding agreements to use 100xSales. By using the service, you represent and warrant that you meet these requirements.
Business Use
100xSales is designed for business use. You agree to use the platform solely for lawful commercial purposes and in compliance with the terms of any third-party platforms you connect (e.g., Meta, WhatsApp Business).
Service Description & License
Platform License
Subject to these Terms, 100xSales grants you a limited, non-exclusive, non-transferable, revocable license to access and use the platform for your internal business operations.
AI Agent Services
Our platform provides AI-powered conversational agents that operate across messaging channels. The performance of AI agents depends on the quality of training data, configurations, and third-party platform APIs, which may change without notice.
Subscription Plans
Access to features is determined by your subscription tier. We reserve the right to modify features included in any plan with 30 days' prior notice. Continued use of the service after such notice constitutes acceptance of the changes.
Message Limits
Each subscription plan includes a monthly message allocation. Messages are counted per individual AI agent response. Unused messages do not roll over to the next billing period.
Acceptable Use Policy
Prohibited Activities
You may not use 100xSales to send spam, unsolicited messages, or engage in deceptive practices. You may not use the platform for any illegal purpose, including but not limited to fraud, harassment, or the distribution of malware.
Content Standards
You are solely responsible for all content processed through the platform, including AI agent training data and conversation content. Content must not violate any applicable laws or infringe on the rights of any third party.
API & Integration Compliance
You must comply with the terms of service of all integrated platforms (WhatsApp Business API, Instagram, Facebook Messenger). Violations of third-party platform policies may result in immediate account suspension.
Rate Limits & Fair Use
You may not attempt to circumvent message limits, use automated scripts to scrape data, or engage in any activity that disrupts or degrades the service for other users.
Disclaimers & Limitation of Liability
AI Accuracy
100xSales AI agents are designed to provide accurate responses, but we do not guarantee the accuracy, completeness, or reliability of any AI-generated content. You are responsible for reviewing AI outputs before relying on them for business decisions.
Service Availability
We strive to maintain 99.9% uptime, but we do not guarantee uninterrupted access to the platform. We are not liable for downtime caused by third-party platform outages, maintenance windows, or circumstances beyond our control.
Limitation of Liability
To the maximum extent permitted by law, 100xSales' total liability for any claim arising out of or related to these Terms shall not exceed the amount you paid to us in the 3 months preceding the claim.
Indirect Damages
In no event shall 100xSales be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, even if advised of the possibility of such damages.
Intellectual Property
Our IP
The 100xSales platform, including all software, AI models, designs, logos, and content created by us, is our exclusive property and is protected by intellectual property laws.
Your Data
You retain ownership of all data you provide to the platform. By using 100xSales, you grant us a limited license to process and use your data solely to deliver our services to you.
Feedback
If you provide feedback, suggestions, or ideas about our services, we may use them without restriction or compensation. Such feedback is deemed non-confidential.
Termination & Modifications
Termination by You
You may cancel your subscription at any time through your account settings. Your access will continue until the end of the current billing period. No prorated refunds are provided for early cancellation.
Termination by Us
We reserve the right to suspend or terminate your account immediately for violations of these Terms, or with 14 days' notice for any other reason. Upon termination, your data will be retained for 30 days before deletion.
Modifications to Terms
We may update these Terms at any time. We will notify you by email of material changes at least 14 days before they take effect. Continued use of the platform after the effective date constitutes acceptance.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of Bangladesh. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Dhaka, Bangladesh.
